1. Acceptance of Terms
Welcome to PlayNest Kids. By accessing and using our nature-inspired indoor playground facilities, you agree to comply with and be bound by the following terms and conditions of use. These terms govern your relationship with PlayNest Kids and apply to all visitors, guests, and users of our services. If you disagree with any part of these terms, please do not use our facilities or services.
These Terms of Service constitute a legally binding agreement between you (the visitor or guardian) and PlayNest Kids. We reserve the right to modify these terms at any time, and such modifications will be effective immediately upon posting to our website. Your continued use of our facilities following any changes indicates your acceptance of the new terms.
2. Facility Use and Supervision
PlayNest Kids is designed as a supervised play environment for children. Parents, guardians, or responsible adults must remain on the premises at all times while children are using our facilities. All children under 12 years of age must be accompanied by an adult who assumes full responsibility for the child's behavior and safety.
Our staff members provide general supervision and facility oversight, but primary responsibility for child safety and behavior rests with the accompanying adult. Parents and guardians must ensure their children follow all posted rules, respect other visitors, and use equipment appropriately. We reserve the right to remove any individual from the premises for behavior that endangers others or disrupts the enjoyable experience of fellow guests.
Age and height restrictions apply to certain play zones and equipment. These restrictions are clearly posted and must be observed for safety reasons. Our staff has the authority to deny access to any zone or equipment if they determine a child does not meet the requirements or if safety concerns exist.
3. Safety Rules and Regulations
The safety of all visitors is our highest priority. All guests must comply with safety rules posted throughout the facility and follow instructions provided by PlayNest Kids staff members. Safety equipment, including harnesses for climbing walls and protective padding in active zones, must be used as directed.
Visitors must wear appropriate footwear and clothing suitable for active play. Loose jewelry, sharp objects, and items that could pose safety hazards are not permitted in play areas. Food and beverages are restricted to designated areas only and must not be brought into active play zones.
Children with specific medical conditions, physical limitations, or behavioral concerns must be supervised appropriately by their guardians. Please inform our staff of any conditions that may affect participation in activities so we can provide appropriate guidance and assistance.
4. Assumption of Risk and Liability
Physical activity and play involve inherent risks. By entering PlayNest Kids, you acknowledge that participation in playground activities carries risks of injury, including but not limited to scrapes, bruises, sprains, and more serious injuries. You voluntarily assume all risks associated with participation in our activities and use of our equipment.
PlayNest Kids maintains comprehensive safety protocols and equipment maintenance schedules to minimize risks. However, we cannot guarantee that injuries will not occur. All visitors participate in activities at their own risk. Parents and guardians assume full responsibility for their children's participation and any resulting injuries.
PlayNest Kids, its owners, employees, and affiliates shall not be liable for any injuries, losses, or damages arising from the use of our facilities, except where such liability cannot be excluded by law. We strongly recommend that all visitors maintain appropriate personal insurance coverage.
5. Health and Hygiene Requirements
To maintain a healthy environment for all visitors, we require that sick children or those exhibiting symptoms of contagious illness do not enter the facility. This includes but is not limited to fever, vomiting, diarrhea, contagious rashes, or respiratory infections. If a child becomes ill while at PlayNest Kids, parents or guardians must remove the child from the facility immediately.
We maintain regular cleaning and sanitization schedules throughout the facility. Hand sanitizing stations are available, and we encourage all visitors to practice good hygiene. Diaper changing is permitted only in designated areas equipped with appropriate facilities.
6. Bookings, Cancellations, and Events
PlayNest Kids accepts bookings for general admission, birthday parties, group events, and special programs. All bookings are subject to availability and must be confirmed in advance. We reserve the right to decline or cancel any booking at our discretion.
Cancellation policies vary depending on the type of booking. General admission tickets are typically non-refundable but may be rescheduled subject to availability. Special events and party bookings require advance notice for cancellations or modifications. Please refer to your booking confirmation for specific cancellation terms.
Group bookings and educational programs have specific requirements and terms that will be communicated during the booking process. We work with schools, community organizations, and other groups to provide tailored experiences that meet their needs while maintaining safety and quality standards.
7. Photography and Media Use
PlayNest Kids may photograph or video record activities within the facility for promotional, educational, or documentation purposes. By entering our facility, you consent to such recording and grant PlayNest Kids permission to use images or videos that may include you or your children in marketing materials, website content, social media, or other promotional contexts.
If you do not wish to be photographed or recorded, please inform our staff upon arrival. We will make reasonable efforts to accommodate your request, though we cannot guarantee that you will not appear in background shots or group photos.
Personal photography and video recording by visitors is permitted for personal use only. However, images and videos taken at PlayNest Kids may not be used for commercial purposes or widely distributed without our written permission. Please be respectful of other families' privacy when taking photos or videos.
8. Personal Property and Lost Items
PlayNest Kids is not responsible for lost, stolen, or damaged personal property. Visitors are encouraged to leave valuables at home or secure them in designated storage areas. We provide lockers and storage options, but use of these facilities is at your own risk.
Lost and found items are retained for a limited period. Please contact our staff if you have lost an item during your visit. We will make reasonable efforts to locate lost property, but we cannot guarantee its recovery. Unclaimed items may be donated to charity or disposed of after a reasonable holding period.
9. Prohibited Conduct
To ensure a safe and enjoyable environment for all visitors, the following behaviors are strictly prohibited: physical aggression or bullying, use of offensive language, vandalism or intentional damage to property, consumption of alcohol or illegal substances, smoking or vaping anywhere on the premises, and unauthorized commercial activity or solicitation.
Violations of these conduct rules may result in immediate removal from the facility without refund. Serious violations may result in permanent bans from PlayNest Kids and, where appropriate, reporting to law enforcement authorities.
10. Intellectual Property
All content, designs, logos, text, graphics, and other materials associated with PlayNest Kids are protected by copyright, trademark, and other intellectual property laws. The PlayNest Kids name, logo, and distinctive design elements are trademarks owned by PlayNest Kids and may not be used without express written permission.
You may not reproduce, distribute, modify, or create derivative works from any content found on our website or within our facilities without prior written authorization. This includes but is not limited to photographs, promotional materials, signage, and educational content.
11. Privacy and Data Protection
PlayNest Kids collects and processes personal information in accordance with applicable privacy laws and regulations. Our collection and use of personal data is governed by our Privacy Policy, which should be read in conjunction with these Terms of Service.
By using our services, you consent to the collection, use, and storage of your personal information as described in our Privacy Policy. Parents and guardians are required to provide accurate emergency contact information during registration. It is your responsibility to ensure this information remains current. In the event of a medical emergency involving a child, we will attempt to contact the designated emergency contacts while providing appropriate first aid and summoning emergency medical services as needed.
